In de Raad van Europa, tegen de borgtocht van Saban Baran

Turkije heeft Saban Baran op borgtocht vrijgelaten.

Baran is tot 7,5 jaar veroordeeld voor mensenhandel en nog eens bij verstek tot 8 jaar voor tweevoudige poging tot moord. In Nederland is hij in September ontsnapt, toen hij een omstreden kort verlof kreeg om zijn kind te bezoeken.

Hij vluchtte naar Turkije, waar hij pas in Februari werd opgepakt. Maar nu is hij op borgtocht (tegen ongeveer €16.000 euro, terwijl hij vervolgd wordt voor miljoenenfraude) vrijgelaten. Dat is heel slecht nieuws voor Nederlandse slachtoffers, maar misschien nog wel slechter nieuws voor Turkse burgers en ouders, gezien zijn ‘staat van dienst’.

Daarom stel ik vandaag vragen aan alle 47 ministers van justitie in de Raad van Europa. Zowel Turkije als Nederland is lid en ik ben zeer benieuwd wat de andere Europese staten vinden van dit staaltje gebrek aan samenwerking tussen deze twee landen en de gevolgen daarvan.

In de Juridische commissie spreken we vaak over gezamenlijke bestrijding van terrorisme, van zware criminaliteit en van mensenhandel. Nou, als we dat zo doen met zijn allen, worden onze straten niet veiliger.

Ik zal de komende tijd aandringen op een spoedig antwoord.

Questions to the council of Ministers on the release on bail of Saban Baran in Turkey

Saban Baran received 7,5 years sentence for inter alia forced prostitution of more than 100 women in the Netherlands. He was furthermore in absentia sentenced to eight years for two accounts of attempted murder.

In Dutch prison he made his girl friend pregnant. The Dutch authorities gave him a short release to visit his new born baby last September. He fled to Turkey instead.

In February 2010 the Turkish authorities arrested him on multiple charges, but they have just released him on bail. There is a real risk that he will try to escape again.

The members ask the committee of Ministers:

  • 1. 
    Do they agree that the cooperation between Turkey and the Netherlands in prosecuting, bring to trail and executing the sentence of Saban Baran could be improved considerably? If yes, what steps will the committee of Ministers advise Turkey and the Netherland take to improve that cooperation? And what is the reply of both the Netherlands and Turkey to those suggestions of better cooperation?
  • 2. 
    Does the committee of ministers agree that given the history, it is not wise to release this man on bail? If so, will they tell so openly and clearly to the competent authorities and ask them to stop the bail?
  • 3. 
    Which steps should be taken by the Turkish and Dutch authorities such that Saban Baran gets a speedy and fair trial and such that justice is done for the crimes for which he has already been condemned in the Netherlands?
