COUNCIL DECISION (EU) 2021/2132

of 29 November 2021

on the position to be taken on behalf of the European Union within the Joint Committee established by the Agreement on civil aviation safety between the European Union and the Government of the People’s Republic of China, as regards the adoption of the rules of procedure of the Joint Committee

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 100(2) in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

 

(1)

The Agreement on civil aviation safety between the European Union and the Government of the People’s Republic of China (1) (‘the Agreement’) was approved on behalf of the Union by Council Decision (EU) 2020/1075 (2) and entered into force on 1 September 2020 (3).

 

(2)

Article 11(1) of the Agreement provides for a Joint Committee of the Parties to be established for the effective functioning of the Agreement.

 

(3)

Article 11(3) of the Agreement further provides that the Joint Committee is to draw up and adopt its rules of procedure.

 

(4)

The Commission and the Civil Aviation Administration of China have cooperated in drawing up draft rules of procedure.

 

(5)

It is appropriate to establish the position to be taken on behalf of the Union within the Joint Committee as regards the adoption of the rules of procedure of the Joint Committee, as they will be binding on the Union. The position of the Union within the Joint Committee should be based on the draft Joint Committee Decision,

HAS ADOPTED THIS DECISION:

Article 1

  • 1. 
    The position to be taken on behalf of the Union at the first meeting of the Joint Committee established by the Agreement on civil aviation safety between the European Union and the Government of the People’s Republic of China as regards the adoption of the rules of procedure of the Joint Committee shall be based on the draft Decision of the Joint Committee (4).
  • 2. 
    The representatives of the Union within the Joint Committee may agree to minor changes to the draft Decision of the Joint Committee without a further decision of the Council.

Article 2

This Decision shall enter into force on the date of its adoption.
