COUNCIL REGULATION (EC) No 2477/94 of 23 November 1994 temporarily suspending the autonomous Common Customs Tariff duties on a number of products intended for the construction, maintenance and repair of aircraft
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty establishing the European Community, and in particular Article 28 thereof,
Having regard to the proposal from the Commission,
Whereas production of the products referred to in this Regulation is at present inadequate or non-existent within the Community and producers are thus unable to meet the needs of user industries in the Community;
Whereas it is in the Community's interest to suspend the autonomous Common Customs Tariff duties for these products completely;
Whereas the decision for the suspension of these autonomous duties should be taken by the Community;
Whereas, taking account of the difficulties involved in accurately assessing the development of the economic situation in the sectors concerned in the near future, these suspension measures should be taken only temporarily, by fixing their period of validity by reference to the interests of Community production,
HAS ADOPTED THIS REGULATION:
Article 1
From 1 January to 31 December 1995, the autonomous Common Customs Tariff duties for the products listed in the Annex shall be totally suspended, provided that the said products are intended, on conditions to be determined by the competent authorities, for the construction, maintenance and repair of aircraft.
Article 2
This Regulation shall enter into force on 1 January 1995.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

ANNEX
List of products in respect of which Common Customs Tariff duties are totally suspended where such products are intended for the construction, maintenance and repair of aircraft of an unladen weight exceeding 2 000 kilograms
Notes for the purpose of the following table:
(a) Category A comprises aeroplanes of an unladen weight exceeding 15 000 kilograms other than those specified under (b);
(b) Category B comprises aeroplanes of the following types: BAC 1-11, Airbus, Concorde, Mercure and F 28;
(c) Category C comprises aeroplanes and helicopters of an unladen weight exceeding 2 000 kilograms but not exceeding 15 000 kilograms.
