adapting to technical progress Directive 97/68/EC of the European Parliament and of the Council on the approximation of the laws of the Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion engines to be installed in non-road mobile machinery

THE COMMISSION OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Community,

Having regard to Directive 97/68/EC of the European Parliament and of the Council of 16 December 1997 on the approximation of the laws of the Member States relating to measures against the emission of gaseous and particulate pollutants from internal combustion engines to be installed in non-road mobile machinery(1), and in particular Article 14 thereof,

Whereas:

  • (1) 
    The scope of Economic Commission for Europe (ECE) Regulation No 96 on emissions from compression ignition engines to be installed in agricultural and forestry tractors has been extended to cover also other types of non-road mobile machinery.
  • (2) 
    The European Community is a contracting party to the said ECE Regulation.
  • (3) 
    It is necessary to align the technical requirements in that Regulation with the corresponding requirements in Directive 97/68/EC.
  • (4) 
    The measures provided for in this Directive are in accordance with the opinion of the Committee for Adaptation to Technical Progress established by Council Directive 92/53/EEC(2).
  • (5) 
    Directive 97/68/EC should be amended accordingly,

HAS ADOPTED THIS DIRECTIVE:

Article 1

Annexes III and IV to Directive 97/68/EC are hereby amended in accordance with the Annex to this Directive.

Article 2

This Directive shall not invalidate any approval granted prior to the date mentioned in Article 3 pursuant to Directive 97/68/EC nor prevent extensions to such approvals under the terms of the Directive under which they were originally granted.

Article 3

Member States shall bring into force the laws, regulations and administrative provisions necessary to comply with this Directive by 30 June 2002 at the latest. They shall forthwith inform the Commission thereof.

When Member States adopt those provisions, they shall contain a reference to this Directive or be accompanied by such a reference on the occasion of their official publication. Member States shall determine how such reference is to be made.

Article 4

This Directive shall enter into force on the 20th day following that of its publication in the Official Journal of the European Communities.

Article 5

This Directive is addressed to the Member States.

ANNEX

Amendments to Annexes III and IV to Directive 97/68/EC

  • 1. 
    Annex III is amended as follows:
  • (1) 
    in paragraph 2.2.2, the formula shall be replaced by the following: 0,96 <= fa <= 1,06
  • (2) 
    in Appendix 2, paragraph 1.2.1, third indent "CO" shall be replaced by "CO2";
  • (3) 
    in Appendix 2, paragraph 1.9.2.2 is replaced by the following: "1.9.2.2. Water quench check

This check applies to wet gas concentration measurements only. Calculation of water quench must consider dilution of the NO span gas with water vapour and scaling of water vapour concentration of the mixture...
