COMMISSION OF THE

COMMUNICATION SUBMITTED BY THE COMMISSION TO
THE COUNCIL .
On the occasion of its meeting of the 31 May/1 June 1976, the Council decided to issue a directive to the Commission to negotiate with the International Energy Agency an outline agreement, in the form of an exchange of letters, stating the intentions of the two parties to co-operate, under agreements to be concluded, in the field of research and development.
The Council will find attached here :
1) the text of a draft outline agreement in the form of an exchange of letters which has been negotiated in implementation of this directive;
2) a draft decision on the conclusion of this agreement.
The Commission draws the Council's attention to the urgency of this matter. The Commission must be able to sign these two "Implementing Agreements" which have been already approved by the Council on the 31 May/1 June, as soon as possible.

DRAFT FOR AN EXCHANGE OF LETTERS BETWEEN
THE PRESIDENT OF THE GOVERNING BOARD '
OF THE IEA AND THE REPRESENTATIVE OF THE COMMISSION
Mr President,
As you know, research and development programmes in the energy field are carried out in the framework of the EEC and the EAEC. Many of these programmes concern areas in which the International Energy Agency also has R & D programmes.
I have the honour to inform you, by this letter, that the EEC and EAEC intend to co-operate with the IEA in research' and development when such a co-operation is likely to contribute towards the attainment of the research and development objectives of the Community in the field of energy R & D.
This co-operation can be achieved through Community participation in the programmes and projects of the Agency. In particular, the Commission of the European Communities shall negotiate on a case by case basis, "Implementing Agreements" in accordance with the provisions of the Treaties establishing the European Communities.

DEVELOPMENT
The Council of the European Communities,
Having regard to the Treaty establishing the European Atomic Energy Community, and in particular the second paragraph of Article 101, thereof,
Having regard to the Treaty establishing the European Economic Community, and in particular Article 228 thereof.
Having regard to the proposal from the Commission,
Whereas the Commission has negotiated in accordance with the Council's directive of 31 May 1976, an outline agreement between the EAEC and the EEC on the one hand and the IEA on the other, '
Whereas it is advisable to approve the conclusion of this agreement in so far as it is within the scope of the EAEC Treaty,
Wherears, it is advisable to conclude the said agreement in so far as it is within the scope of the EEC Treaty,
HAS DECIDED AS FOLLOWS :
Article 1
To approve, in so far as it is within the scope of the EAEC Treaty, the agreement between the EAEC and the EEC on the one hand, and the IEA on the other, for co-operation in the field of energy research and development.
Article 2
To conclude, in so far as it is within the scope of the EEC Treaty, this agreement between the EAEC and the EEC,on the one hand,and the EEC on the other.
Article 3
The President of the Council is authorized to designate the signatory of the agreement, in so far as it is within the scope of the EEC Treaty.
