1. In application of Article 11 of Council Decision 7l/66/£E0 (l) the Commission

presented on 8 October 1982 its Opinion to the Council on the revi w of the rules governing the tasks of the European Social Fund (2). The Commission proposes that Decision 71/66/EEC should be replaced by a new Decision.

The present structure of Fund aid is divided into two parts under Articles 4 and 5 of Decision 7l/66/feEC; these are in turn divided into nine separate fields of intervention. It is this system which would be replaced by the new provisions foreseen in the Commission's Opinion.

Four of the five Decisions adopted under Article 4 of Decision 7l/66/iEC concern respectively aid to young people under 25 (3), workers in the textile and clothing industries (4)' migrant workers (5) and women (6).

These four Decisions are due to expire on 31 December 1982, unless extended by Council Decision. They are referred to in the second paragraph of Article 9 of the draft Decision annex ed to the Commission's Opinion cited above: "The Decision 71/66/feEC, as amended by Decision 77/801/EEC, is hereby repealed. However, that Decision and the Decisions taken by virtue of Article 4 of that Decision, shall remain in force in respect of operations for which applications are submitted before 1 April 1983". Irrespective of the outcome of the current review of the Social Fund, it will be necessary to extend the effect of these four Decisions for a period beyond 31 December 1982, since the reasons which led the Council originally to identify these fields of intervention as in need of Fund support during the current severe recession still prevail. Moreover, Fund applicants have already submitted their applications for the first half of 1982 on the basis of existing rules. It is therefore proposed that for the four Decisions taken by virtue of Article 4 of Decision 71/66/EEC concerning aid to young people under 25, textile and clothing workers, migrant workers and women, the expiry date be repealed.

The Committee of the European Social Fund was consulted before the Commission presented its Opinion on the review of the Fund, of which this proposal forms an integral part.    1

The European Parliament and the Economic and Social Committee are to be

consulted on the review as such. However, their consultation on the present arrangement is optional.

amending Decisions 75/459/EEC, 76/206/EEC, 77/803/EEC and 77/804/EEC concerning European Social Fund aid measures for certain categories of persons

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Decision 71/66/EEC of 1 February 1971 on the reform of the European Social Fund (1), as amended by Decision 77/801/EEC (2), and in particular Article 4 thereof.

Having regard to the proposal from the Commission;

Whereas:

- Council Decision 75/459/EEC of 22 July 1975 on action by the European Social Fund for persons affected by employment difficulties (3)

- Council Decision 76/206/EEC of 9 February 1976 on intervention by the European Social Fund in favour of persons employed in the textile and clothing industries (4)

- Council Decision 77/803/EEC of 20 December 1977 on action by the European Social Fund for migrant workers (5)

as last amended by Decision 80/1117/EEC (7), apply only to operations covered by applications for assistance approved by the Commission before 1 January 1983; whereas the imbalance in the fields of employment covered by the said Decisions persists; whereas the time limit on intervention shoulc accordingly be abolished.
